Réglementation

For a stay of less than 3 months, all EU member states and the following countries are exempt from the obligation of obtaining a visa: Liechtenstein, Malaysia, Mauritius, Mexico, Monaco, New Zealand, Nicaragua, Norway, Panama, Paraguay, San Marino, Seychelles, Singapore, St. Christoph and Nevis, Switzerland, South Korea, United States (USA), Uruguay, Venezuela., Andorra, Antigua and Barbuda, Argentina, Australia, Bahamas, Barbados, Brazil, Brunei, Canada, Chile, Costa Rica, Croatia, El Salvador, Guatemala, Honduras, Iceland, Israel, Japan, Liechtenstein, Malaysia, Mauritius, Mexico, Monaco, New Zealand, Nicaragua, Norway, Panama, Paraguay, San Marino, Seychelles, Singapore, St. Christoph and Nevis, Switzerland, South Korea, United States (USA), Uruguay, Venezuela.

Citizens of the EU and EEA member states (with the exception of Bulgaria and Romania, that will remain subject to the Foreigners' Employment until 31 December 2013) have free access to the Austrian labour market.

There are two possible ways for the candidate to be employed with a permit:

  • as the direct employee of an Austrian company, this is a Sicherungsbescheinigung (Secured work certificate) application
  • as the employee of a foreign company that is providing services to an Austrian company, Entsendebewilligung (Assignment permit). In this scenario, an Austrian accountant must administer the payrolling of the candidate to ensure that all tax and social security is duly paid
  • For non EU citizens, a work permit does not allow the candidate to travel to or reside in Austria. Once the work permit has been approved the candidate should apply for a residence visa (type D), because a Schengen (type C) visa is not sufficient to take up employment with a work permit. After a three days stay in Austria, all foreign residents must register with the responsible authority

Properties: owner’s permission to film a property is required if foot is set on said property in the course of filming, or, access to a unique view on the property is gained from an uncommon viewpoint (“Private Property Right” – ”Hausrecht”). Aerial photography: no permits are required for and filming from a private aircraft and other private airborne vehicles (e.g. hot-air balloons). It is required for commercial airliners. Before editing and publication of the film material, a copy of all the material shot (prints of pho­tos or VHS tapes) and a written application specifying the position from the air, is to be submitted to the Federal Ministry of Defense. If no military installations were pho­tographed or filmed, a fee-based publication permit is usually granted one week after submission. Copyrighted work/artwork (i.e. paintings, sculptures): a reproduction, adaptation, or alteration permit from the copyright owner generally needs to be obtained. Public access to street images: can also be extended to interior parts of a building, such as a staircase, courtyard, lobby, individual halls and rooms, interior architecture, glass windows, and frescos as long as the reproduction of the interior and exterior can be seen as one unified image. Compliance with this interpretation of the “public access provision“ is examined on a case-by-case basis.

Austrian copyright law is, similar to most other continental European countries, which focus on a natural person, the creator of a piece of work or art to be the original copywright owner. Austrian copyright law always requires a natural person, the creator of the work, to be the original copywright owner. Artificial persons, or legal entities, can either be original owners of “ancillary copyrights”, a related law (”Leistungsschutzrecht”), or, owners of various exclusive and non-exclusive (work) user licenses derived by the author. Furthermore, Austrian copyright law embraces distinct personal copyright rights, some unrenounceable, such as the right to claim copyright, the right to publish the contents of the work, the right to keep the integrity of the work, etc. A piece of work is protected as a whole and as its individual parts, for example, one also needs permission from the copyright owner to only use a few bars of a song. In compliance with an EU directive, a 70-year protection period post mortem auctoris generally applies for copyrighted work in Austria.
